A Good Start, But A Long Way to Go To Protect New York Drivers

HOORAY! THE STATE HAS PASSED A BAN ON TEXTING WHILE DRIVING

While I am generally a libertarian, I am pleased that the New York State legislature has passed a new law banning texting while driving and the use of certain other electronic devices while driving. While the law is far from perfect, it is at least a step in the right direction toward the goal of banning the use of all electronic devices while driving.
The flaws in the new law? Even though everyone agrees just how dangerous texting and driving is, a police officer may not stop your vehicle if he sees you texting and driving. The officer can only ticket you for texting while driving if he has stopped your car for an unrelated reason. What is the philosophy behind that? I just don’t get it.
Further, you can still talk on your cell phone while driving provided you use a hands-free device. In my opinion, a good argument could be made that talking with a hands-free device is more dangerous than is a traditional phone, due to the extra hardware often needed (putting in ear pieces, farting around with wires, etc.).
Lastly, why should I be able to scroll through the hundreds of songs on my iPod while driving but not through the phone numbers in my phone? It seems to me that they are equally distracting. I suppose we will have to wait for another car full of young folks to be killed while the driver was distracted by an iPod or other device before their use is banned, too.
