
Outrageous Behavior Demands Outrageous Consequences
Julie Stratton of Snyder, New York, was having a bad day. As she was driving west bound on the New York Thruway last month, she struck a deer that had run into the path of her car. Worse yet, the impact disabled her vehicle, which was still in the roadway. She did the right thing and immediately called 911 to ask for help and instruction. But before the 911 operator could advise her what to do, she was killed when her car was rammed from behind by a tractor trailer. Ms. Stratton, age 33, is survived by her husband and two small children, ages 3 and 1.
According to police authorities, the driver of the tractor trailer, Thomas Wallace of Ohio, had been operating on almost no sleep (four hours out of the last twenty seven he was on duty). Police also report that he had falsified his logbook which truckers are required to maintain that show how much rest and sleep they have had for the hours they have been driving.
And that is not the worst of it. According to a forensic examination of his laptop computer, which was found in the cab of his truck, Mr. Wallace had been watching pornographic movies at the time of the crash. Such irresponsible, reckless behavior demands that he be punished to the maximum the criminal law will allow.
Certainly Ms. Stratton’s family will sue Mr. Wallace and the trucking company for whom he worked, and rightly so. I hope the family attorney takes the case to trial so that the jury can hear just how grossly reckless Mr. Wallace was behaving. As an upstate injury lawyer, I beleive that Wallace and the company he worked for need to be punished severely for his actions, and a substantial jury verdict would go a long way toward sending the message that outrageous behavior begets outrageous results.
