Injury Lawyer and Author Warns Against Use of Hunting Stand

Last Fall, a client of mine from Livingston County man who was very seriously injured when a hunting treestand he was in collapsed underneath him, causing him to fall about fourteen feet to the ground. Since that time, a professional engineer examined the treestand and found it to be defective. Attorney Joe Moran and I are now prosecuting this case against the big box hunting products store that sold the stand in federal court in Rochester. In researching other claims against treestand sellers and manufacturers, I was stunned to learn just how dangerous and widespread injuries and deaths are that are caused by these products. The Consumer Product Safety Commission in Washington reported earlier this year the results of a study of treestand accidents from 2005-2007. Over this three year period, there were 18,980 treestand related injuries treated at U.S. hospitals, including 41 deaths, or an annual average of 6,327 injuries and 13.6 fatalities. Think your safe if your wearing a harness in the tree? Think again. Depending how high the stand is set in the tree, many experts believe you are better off taking your chances falling to the ground, rather than dying from strangulation while suspended in the harness. Of the 41 deaths detailed in the CPSC report, 7 were the result of strangulation by a harness, including a 53 year old man found hanging just five feet off of the ground. What to do then? Personally, having studied many of the injury and fatality cases in the CPSC report in detail, I have decided to do my hunting on the ground. And guys, if your wife or significant other is giving you an earful about you hunting out of a treestand after reading this article, I apologize. But as they say, it is better to be safe, than sorry.
