Why NOT Pursuing a Case Was the Right Decision After All

Injury Lawyer Is Reminded by Client What Life Is All About

Listen to Scott's radio show, "Cannon's Law- Opening Fire" on WYSL 1040AM and FM TALK 92.1, Saturday mornings 8:00-9:00, and Sunday evenings from 6:00-7:00.

PEOPLE, LIFE ARE MORE IMPORTANT THAN MONEY

Having trials is the best part of being a personal injury lawyer. I like it so much in fact, that I have to make sure I don’t let my desire to bring a case to trial overshadow the client’s desire to settle out of court. Or, as in the case of recent client from Rochester, Monroe County, New York, overshadow the client’s desire not to pursue the case at all.
This client (whom I now also consider a friend), was injured when she was struck by a car walking through a parking lot. She received an injury to her knee. Because she had hurt this same knee years earlier, the insurance company for the driver who hit her would not make a reasonable settlement offer, which left us with no choice but to start a lawsuit and fight it out in court. Or so I thought.
As it turns out, the client, “Marla”, not only had the bad luck of getting hit by a car, she had worse luck in recently being diagnosed with a very rare and serious illness. After much discussion, soul searching and prayer, Marla decided against pursuing the case against the driver, opting instead to spend her time and energy with her family and getting better.
I admire Marla for the decision she has made. She felt very passionately about holding the woman who ran her down responsible for her actions, but she was able to let that go and realize that people and living her life are vastly more important than money.
Hooray for Marla. May we all be as wise as she. And may we all realize that the people in our lives are what make life worth living.
