If the injured person was killed as a result of the accident, that person's family has only two years from the date of death to sue for wrongful death.  If a municipality including the State of New York is a possible defendant, then the injured person must file a notice of claim against the municipality within ninety days of the accident, and then the person has one year to start a lawsuit.  Disability provisions also come into play.  Further, if a defective product may have caused the accident, a four year product liaiblity statute of limitations may apply.
